Applicability

Published by Dravara, LLC. This notice describes the scope and practices stated below. Publication does not activate an unavailable service or, by itself, establish a user's agreement to a contractual provision.

A contractual provision requiring your agreement applies only where there is a legally effective agreement and only to the extent permitted by applicable law. Nothing published here makes privacy rights, other nonwaivable rights or Dravara's legal obligations depend on your accepting a contractual provision.

Third-party names and marks remain their owners' property, and their appearance does not imply affiliation, sponsorship, endorsement or participation. A partnership, acquisition, licensing or other commercial relationship requires a separate written agreement.

Reporting infringement

  • To report suspected copyright infringement on PUPMKT, email dmca@pupmkt.com or write to Dravara, LLC at 3564 Avalon Park E Blvd Ste 1-A881, Orlando, FL 32828. Identify the copyrighted work, the material and location on PUPMKT, your contact information, and your authority to make the report. Do not assume that an ordinary support ticket reaches a registered DMCA agent.
  • A notice intended to meet 17 U.S.C. §512(c)(3) should include: a physical or electronic signature of the owner or authorized representative; identification of the work, or a representative list where permitted; identification and location of the allegedly infringing material; reasonably sufficient contact information; a statement of good-faith belief that the use is not authorized by the owner, its agent or law; and a statement that the notice is accurate and, under penalty of perjury, that the sender is authorized to act for the owner.

Review, counter-notice and repeat infringement

  • Dravara reviews reports and may remove or restrict material as required or appropriate. If material you provided is removed following a copyright report, you may contact us to explain an error. Where the statutory counter-notice process applies, a counter-notice must identify the removed material and its former location; include your signature, name, address and telephone number; state under penalty of perjury your good-faith belief that removal resulted from mistake or misidentification; and include the jurisdiction and service statements required by 17 U.S.C. §512(g)(3). For a U.S. address, that includes consent to the jurisdiction of the federal district court for the district containing your address; for an address outside the United States, it includes consent to the jurisdiction of a federal district court in a district where the service provider may be found. It also includes acceptance of service from the original complainant or its agent.
  • A counter-notice can be forwarded to the original complainant. Where the statutory process applies, restoration follows its requirements, including the 10–14-business-day framework and the exception for notice of the specified court action. It is not an instant automatic appeal. Knowing material misrepresentations can have legal consequences. Dravara may restrict or terminate access in appropriate circumstances involving repeated infringement, subject to applicable law and an opportunity to request review where appropriate.
